Purchase of Residential Property Sale of Residential Property
We can advise you in connection with Home Reports, surveys, making an offer, negotiating the price with a seller, and offering at a closing date. If your offer is accepted, we will carry out the legal work, including advising you on the contract (missives), examining the title deeds, reporting to you on legal burdens and conditions affecting the property, examining searches, preparing the documentation necessary to transfer ownership of the property to your name, dealing with the security paperwork required in connection with your mortgage, preparing and submitting a Stamp Duty Land Tax return on your behalf, and submitting an application for registration of your title in the Land Register of Scotland.
Whether you have sold you property through our estate agency department or not, we can carry out the legal work involved in the sale. That work will include examining the detailed provisions of the successful offer and preparing a formal acceptance, obtaining searches and reports, preparing a discharge of your lender's Standard Security (mortgage deed), obtaining a Redemption Statement showing the amount required to repay your mortgage, dealing with observations on title raised by the purchaser's solicitors, concluding the contract on your behalf, arranging for the amount due to your mortgage lender to be repaid, settling the sale on the date of settlement and accounting to you for the free proceeds of sale.
In addition to the purchase and sale of residential property, our residential property services include residential lettings, housing, re-mortgages, general conveyancing work and the purchase and sale of building plots.
